RESOLUCION Nº 101
Córdoba, 24 de Noviembre de 2006
Expediente Nº 0047-012901/06.-
VISTO: este expediente en el que la Dirección Provincial de
Arquitectura dependiente del Ministerio de Obras y Servicios
Públicos, propicia por Resolución Nº 345/06, se adjudique en
forma directa la ejecución de los trabajos de la obra: “QUINIENTOS
NOVENTA Y OCHO (598) MÓDULOS para la realización de los
trabajos que oportunamente se determinen en el PLAN DE
REPARACIONES Y REFACCIONES DE ESTABLECIMIENTOS
EDUCACIONALES EN TODA LA PROVINCIA – GRUPO 2 –
PROVINCIA DE CÓRDOBA”, a la Empresa L & A
CONSTRUCCIONES S.R.L., por la suma total de $ 374.204,48.
Y CONSIDERANDO:
Que la contratación que se propicia se origina como consecuencia
de la nota cursada a fs. 2 de autos por el señor Ministro de Educación,
solicitando al señor Ministro de Obras y Servicios Públicos
instrumentar un Plan de Emergencia de Reparaciones y
Refacciones de Escuelas que permita atender de manera inmediata
las necesidades planteadas por establecimientos educacionales
de la Provincia y concretar de forma urgente las intervenciones a
realizar en los rubros de instalaciones eléctricas, sanitarias,
pluviales, pintura y refacciones.
Que atento las razones de urgencia invocadas por la Dirección
Provincial de Arquitectura la contratación en la forma que se propicia
encuentra sustento legal, en cuanto a su modalidad y procedencia,
en las previsiones del artículo 7º, Inciso b) de la Ley de Obras
Públicas Nº 8614.
Que la citada Dirección ha aprobado la documentación Técnica
compuesta de Memoria Descriptiva, Pliego Particular de
Especificaciones Técnicas, Pliego Particular de Estructuras,
Instalación Eléctrica, Instalación Sanitaria, Instalación Gas,
Instalación de Servicios contra Incendio, Cómputo Métrico,
Presupuesto y Pliego Particular de Condiciones, que corre
agregada a fs. 6/106 y 110/139 de las presentes actuaciones.
Que se invitaron a cotizar a tres (3) firmas del medio, surgiendo
de la evaluación efectuada por la Comisión de Estudios de Ofertas
de la citada Dirección a fs. 158, que la propuesta presentada por
la Empresa L & A CONSTRUCCIONES S.R.L. por la suma de $
374.204,48, resulta ser la más conveniente, la oferta de menor
precio y ajustarse a Pliego.
Que se ha realizado la Afectación Preventiva del gasto según lo
dispuesto por el artículo 13 de la Ley de Obras Públicas 8614, e
incorporado el Certificado de Habilitación para Adjudicación a fs.
211 de autos, expedido por el Registro de Constructores de
Obras (artículo 7 del Decreto Nº 8/98 y Resolución Nº 002/99 del
entonces Ministerio de Obras, Servicios Públicos y Vivienda).
Por ello, las disposiciones de la Ley Nº 5901 – T.O. Ley 6300 y
modificatorias y lo dictaminado por la Dirección General de Asuntos
Legales del Ministerio de Obras y Servicios Públicos con el Nº
537/06,
EL SECRETARIO DE OBRAS PÚBLICAS
R E S U E L V E:
ARTÍCULO 1º.- APROBAR la contratación directa para la
ejecución de los trabajos de la Obra: “QUINIENTOS NOVENTA Y
OCHO (598) MÓDULOS para la realización de los trabajos que
oportunamente se determinen en el PLAN DE REPARACIONES Y
REFACCIONES DE ESTABLECIMIENTOS EDUCACIONALES
EN TODA LA PROVINCIA – GRUPO 2 – PROVINCIA DE
CÓRDOBA” y consecuentemente ADJUDICAR la misma a la
Empresa L & A CONSTRUCCIONES S.R.L., por la suma de
Pesos Trescientos Setenta y Cuatro Mil Doscientos Cuatro Con
Cuarenta Y Ocho Centavos ($ 374.204,48).
ARTÍCULO 2º. IMPUTAR el egreso que asciende a la suma
total de Pesos Trescientos Setenta y Cuatro Mil Doscientos Cuatro
Con Cuarenta y Ocho Centavos ($ 374.204,48), conforme lo
indica la Gerencia de Administración dependiente del Ministerio de
Obras y Servicios Públicos en su Documento de Contabilidad
(Afectación Preventiva) Nº 6728/06, con cargo a Jurisdicción 1.25
- Programa 305/0 – Proyecto 90 - Partidas: Principal 12 – Parcial
10 - Obra 2579 del P.V.
ARTÍCULO 3º.- FACULTAR al señor Director de la Dirección
Provincial de Arquitectura dependiente del Ministerio de Obras y
Servicios Públicos a suscribir el contrato correspondiente, previo
cumplimiento por parte del adjudicatario de los recaudos legales
pertinentes.
ARTÍCULO 4º.- PROTOCOLÍCESE, dése intervención a la
Gerencia de Administración del Ministerio de Obras y Servicios
Públicos, al Tribunal de Cuentas de la Provincia, comuníquese,
publíquese en el Boletín Oficial, pase a la Dirección Provincial de
Arquitectura del citado Ministerio a sus efectos y archívese.

VISTO: Lo establecido por el Artículo 16 del Código Tributario
vigente (Ley N° 6006 – T.O. 2004 y modificatorias),
Y CONSIDERANDO:
QUE en virtud de las tareas que se llevan a cabo en el Área
Resolutivo 1 de esta Dirección General de Rentas, se estima
necesario y conveniente asignar a la Agente EVA CRISTINA LEDESMA
– D.N.I. N° 5.881.735 – Personal de Planta Permanente, que
presta servicios en dicha Área, tareas específicas de la misma a los
fines de que proceda a notificar a los Administrados las Resoluciones
que emanan de dicho Sector.
POR ELLO y en virtud de lo establecido por los Artículos 16 y 20
del Código Tributario - Ley N° 6006 - T.O. 2004 y sus modificatorias,

DECRETO Nº 1806
Córdoba, 28 de Diciembre de 2006
VISTO: El expediente Nº 0002-027418/2006 mediante el cual la
Jefatura de Policía de la Provincia propone la promoción de Oficiales
Jefes, a partir del 1º de Enero de 2007.
Y CONSIDERANDO:
Que dichas propuestas se ajustan a lo resuelto por las Juntas de
Promociones para Oficiales Jefes, aconsejándose el ascenso por las
razones y fundamentos que obran en las actas labradas al efecto.
Que la Jefatura de Policía fundamenta la presente propuesta,
expresando que, en los mismos se visualiza la idoneidad para el
cumplimiento de los nuevos roles que su estamento jerárquico impone,
para satisfacer las necesidades orgánicas de la Institución. Asimismo
consigna, que los egresos correspondientes a la presente gestión
serán atendidos con el presupuesto correspondiente al año 2007,
según programa y partidas que el mismo autorice.
Que conforme a lo expuesto, se considera oportuno y conveniente
la Promoción de los Oficiales Jefes en función de lo normado por el
artículo 32º (inciso f) de la Ley Nº 9235/05 y lo establecido en el
Capítulo Quinto (5º), Título II “Régimen de Promociones Policiales” de
la Ley Nº 6702.
Por todo ello, lo dispuesto por el artículo 144º (inciso 1º) de la
Constitución de la Provincia, las Leyes Nros. 9235, 6702 (y
modificatorias) y complementarias, lo dictaminado por la Asesoría
Jurídica del Ministerio de Seguridad y por Fiscalía de Estado bajo
Nros. 443/06 y 1232/06 respectivamente y en ejercicio de sus
atribuciones constitucionales,
EL GOBERNADOR DE LA PROVINCIAD E C R E T A :
ARTÍCULO 1º.- PROMUEVESE, a partir del 1º de Enero de 2007,
al personal policial, Oficiales Jefes, que se detalla en el Anexo Único
de tres (3) fojas que se acompaña al presente decreto.
ARTÍCULO 2º.- IMPÚTASE el egreso que demande lo dispuesto
en el artículo precedente al Presupuesto 2007, conforme la Jurisdicción,
programa y las partidas específicas que fije el mencionado presupuesto
y –en su mérito- AUTORIZASE a la Dirección de Administración de la
Policía de la Provincia a realizar la afectación y liquidación
correspondiente para el cumplimiento de lo dispuesto en el presente
decreto.
ARTÍCULO 3º.- AUTORIZASE al Ministerio Finanzas a efectuar
las adecuaciones presupuestarias –Planta de Personal y Recursos
Financieros- emergentes de lo dispuesto en los artículos 1º y 2º de
este decreto.
ARTÍCULO 4º.- El presente decreto será refrendado por el señor
Ministro de Seguridad y por el señor Fiscal de Estado.
ARTÍCULO 5º.- PROTOCOLICESE, comuníquese a la Dirección
General de Recursos Humanos, publíquese en el Boletín Oficial y archívese.

Córdoba, 28 de Diciembre de 2006
VISTO: El expediente Nº 0002-027417/2006 mediante el cual la
Jefatura de Policía de la Provincia propone la promoción de Oficiales
Superiores, a partir del 1º de enero de 2007.
Y CONSIDERANDO:
Que dichas propuestas se ajustan a lo resuelto por las Juntas de
Promociones para Oficiales Superiores, aconsejándose el ascenso por
las razones y fundamentos que obran en las actas labradas al efecto.
Que la Jefatura de Policía fundamenta la presente propuesta,
expresando que, en los mismos se visualiza la idoneidad para el
cumplimiento de los nuevos roles que su estamento jerárquico impone,
para satisfacer las necesidades orgánicas de la Institución. Asimismo
consigna, que los egresos correspondientes a la presente gestión
serán atendidos con anticipo preventivo de ejercicio año 2007, según
programa y partidas que el presupuesto autorice.
Que conforme a lo expuesto, se considera oportuno y conveniente
la Promoción de los Oficiales Superiores en función de lo normado
por el artículo 32º (inciso f) de la Ley Nº 9235/05 y lo establecido en
el Capítulo Quinto (5º), Título II “Régimen de Promociones Policiales”
de la Ley Nº 6702.
Por todo ello, lo dispuesto por el artículo 144º (inciso 1º) de la
Constitución de la Provincia, las Leyes Nros. 9235, 6702 (y
modificatorias) y complementarias, informes requeridos, lo dictaminado
por la Asesoría Jurídica del Ministerio de Seguridad y por Fiscalía de
Estado bajo Nros. 444/06 y 1244/06 respectivamente, y en ejercicio
de sus atribucionesconstitucionales,
EL GOBERNADOR DE LA PROVINCIA
D E C R E T A :
ARTÍCULO 1º.- PROMUEVESE, a partir del 1º de enero de 2007, al
personal policial, Oficiales Superiores, que se detalla en el Anexo Único de
dos (2) fojas que se acompaña y forma parte del presente decreto.
ARTÍCULO 2º.- IMPÚTASE el egreso que demande lo dispuesto
en el artículo precedente, a “Anticipo Ejercicio 2007” y con el programa
y las partidas específicas que fije el respectivo presupuesto y -en su
mérito- AUTORIZASE a la Dirección de Administración de la Policía
de la Provincia a realizar la afectación y liquidación correspondiente
para el cumplimiento de lo dispuesto en el presente decreto.
ARTÍCULO 3º.- AUTORIZASE al Ministerio Finanzas a efectuar
las adecuaciones presupuestarias -Planta de Personal y Recursos
Financieros- emergentes de lo dispuesto en los artículos 1º y 2º de
este decreto.
ARTÍCULO 4º.- El presente decreto será refrendado por el señor
Ministro de Seguridad y por el señor Fiscal de Estado.
ARTÍCULO 5º.- PROTOCOLICESE, comuníquese a la Dirección
General de Recursos Humanos de la Provincia, publíquese en el
Boletín Oficial y archívese.

VISTO: el Expediente Nº 0002-027422/2006, en el que se
propicia el pase a situación de Retiro Obligatorio por razones de
servicio de Oficiales Jefes, Oficiales Subalternos y Personal
Subalterno de la Policía de la Provincia de Córdoba, a partir del 1º
de enero de 2007.
Y CONSIDERANDO:
Que de las constancias de autos, se desprendeque la medida
propiciada por la Jefatura de Policía de la Provincia encuentra su
fundamento jurídico en las previsiones de los Artículos 55 y 115,
inciso “a” de la Ley Nº 6702, reglamentada por el Decreto Nº
6051/85, en correlación con los Artículos. 95 y 98 de la Ley Nº
8024.
Que en tal sentido, como lo ha sostenido Fiscalía de Estado en
reiterados pronunciamientos, la medida procurada, “el pase a
situación de retiro obligatorio”, debe ser definido como un sistema
de “inestabilidad permanente” que encuentra su justificación jurídica
en el reconocimiento de una necesidad objetiva de la institución
consistente en la renovación periódica de sus cuadros, para
provocar el estímulo y evitar así su estancamiento.
 Por ello, lo dispuesto por el artículo 144
inciso 1º de la Constitución de la Provincia, las Leyes Nº 6702,
modificatorias y complementarias, lo dictaminado por la Asesoría
Jurídica del Ministerio de Seguridad y por Fiscalía de Estado
bajo los Nros. 446/2006 y 1241/06 respectivamente, y en ejercicio
de sus facultades constitucionales,
EL GOBERNADOR DE LA PROVINCIA
D E C R E T A :
ARTÍCULO 1º.- DISPÓNESE, el pase a situación de Retiro
Obligatorio por razones de servicio, a partir del 1º de enero de
2007 y por las causales que indican los fundamentos legales que
se explicitan para cada caso, de los Oficiales Jefes, Oficiales
Subalternos y Personal Subalterno dependientes de la Policía de
la Provincia que se detallan en el Anexo Único de ocho (8) fojas
que se acompaña y forma parte del presente decreto.
ARTÍCULO 2º.- El presente decreto será refrendado por el señor
Ministro de Seguridad y por el señor Fiscal de Estado.
ARTÍCULO 3º.- PROTOCOLÍCESE, comuníquese a la Dirección
General de Recursos Humanos de la Provincia, publíquese en el
Boletín Oficial y archívese.
